"The Studio as an Instrument" AES Platinum Engineers Panel [Fair Use]

Producers and engineers behind hits by Bob Dylan, Weezer, The Flaming Lips, Bjork, Public Enemy, Tribe Called Quest, The National, OK Go, The Prodigy, and more, share clips and stories from some of their favorite projects. Moderators Justin Colletti and Janice Brown interview producer/engineers Dave Fridmann, Chris Shaw, Peter Katis, Damian Taylor, at the 131st AES Convention, October 2011. All audio clips herein are played under the fair use provision for commentary, criticism, reporting and scholarship. ORIGINALLY PUBLISHED SEPTEMBER 20th, 2012 -------UPDATE JUNE 4, 2013 ------ It has come to our attention that this video has been tagged by YouTube's ContentID bot as using copyrighted materials. Although this usage may not be allowed in all countries, in the US many other nations, it fulfills both the letter and the spirit of the "Fair Use Provision" in its entirety. Our Fair Use claim has already been acknowledged and accepted by YouTube and the copyright holder more than once. However, this video may continue to come up in dispute as new publishers join into the ContentID system. In order to help expedite future claims, below is a record of the complete Fair Use dispute we have filed: "All audio clips herein are played under the fair use provision for commentary, criticism, reporting and scholarship. They meet these requirements on all applicable grounds: 1) At well less than 90 seconds, clips are both an unsubstantial portion of the entire video, and an unsubstantial portion of the original works. 2) The clips are used for the purposes of education and commentary, satisfying either or both of these qualifications for fair use. The clips were also played live in the theater where this public event went on, satisfying the "reporting" condition of fair use as well. (Note that only one such qualification is necessary.) 3) Furthermore, the use of these clips has no negative effect on the potential market for, or value of the original works. If anything, the use plays a promotional role for the material. (Note that these clips are a shorter portion of the whole than what is normally used in previews at the iTunes music store.) 4) And finally, the video is owned by a non-profit organization, the Audio Engineering Society. The seminar was hosted by an academic/journalist, and has not been (and never will be) directly monetized for profit. This confirms that this is a non-profit usage, which means it doubly fulfills the fair use requirement for education and scholarship. Each and every one of these indisputable facts means this video fulfills the full requirements of the US fair use provision in every sense of the law. If you can think of even a single reason this wouldn't qualify under the fair use provision, we'd love to hear it. (And this is coming from a journal and an educator who take an assertively pro-copyright stance -- particularly as it applies to recorded music!) Thanks for alerting the Google bots to this false positive. I'm glad the ContentID system is in place, and look forward to seeing this obvious instance of fair use resolved quickly and with a minimum of fuss. At last the Stratocaster custom made body I was waiting for. Made by Warmoth to my specifications and special wood combination and finish this is an authorised Fender body so I can be sure it is perfect and to the exact specifications I needed. This is the body that is going to be used for my latest Strat build, along with other components that I have reviewed recently and there is no doubt that this guitar will be one of the top guitars that I own at any price.
